Terms of Service

1. Agreement
These terms are between Niche Hounds LLC, doing business as Tarmac Hawk (“we”), and the business using tarmachawk.com (“you”). By using the site, requesting a preview, or subscribing, you agree to them. Tarmac Hawk is for business use only, and you must be at least 18.
2. The service
Tarmac Hawk provides state lists of aircraft owners that our model ranks as more likely than average to sell their aircraft. Lists include owner names, aircraft, cities, mailing addresses, and emails where available.
3. Accounts
You sign in with the email on your account and are responsible for activity under it. One subscription covers one company; don't share your account.
4. Plans and billing
Plans are priced per state and billed monthly in advance. Price depends on list size. Weekly plans get a new list every Monday at 6 AM ET; monthly plans get one on the 1st. You can cancel anytime by emailing sales@tarmachawk.com, effective at the end of the paid month. Fees are non-refundable unless we agree otherwise in writing.
5. How you may use the lists
Use the lists only for your own company's business of buying, selling, or brokering aircraft, and only in lawful ways. You may not:
- Resell, share, or publish the lists outside your company
- Use them to decide anyone's eligibility for credit, insurance, employment, or housing
- Tell an owner, or anyone else, that our data says they are selling
- Harass anyone, or keep contacting an owner who asks you to stop
- Scrape the site, get around access limits, or use the lists to build a competing product
Each file is marked so we can trace it to the account that downloaded it.
Tarmac Hawk is not a consumer reporting agency, and the lists are not consumer reports under the Fair Credit Reporting Act.
6. Your outreach
You are responsible for following the laws that apply to how you contact owners, including email, phone, and Do Not Call rules. You will cover our costs, including reasonable legal fees, for any claim that comes from your outreach or your breach of these terms.
7. Removal requests
Owners can ask us to remove their information, including under New Jersey's Daniel's Law, and we remove them from future lists. When we tell you an owner was removed, stop using and delete their information within 5 business days. Forward any removal request you receive to sales@tarmachawk.com.
8. About the data
Our lists come from FAA public records and other sources, and may contain errors. Rankings are statistical estimates from past data, not a promise that any owner will sell. Results we publish describe the past.
9. Ownership
FAA records are public. Our rankings, lists, and site are ours, and your subscription gives you a license to use them, not ownership. You may not use a downloaded list more than 12 months after you downloaded it.
10. Limitation of liability
The service is provided “as is,” without warranties. We aren't liable for indirect or consequential damages or lost deals. Our total liability is limited to what you paid us in the 3 months before the claim.
11. Termination
We may suspend or end your account if you break these terms. Sections 5 through 10 still apply after your account ends.
12. Changes and governing law
We may update these terms. The date at the top shows the latest version, and using the service after a change means you accept it. Pennsylvania law governs these terms, and disputes go to the courts of Erie County, Pennsylvania.
